Mr.

1. You will remember that difficulty arose in

connection with the deportation of one Graham Bushby from

Shanghai to Australia, and we had some correspondence with

the Consul-General at Shanghai and Mr. Peter Grain.

Skinner Turner discussed the matter with me when he was here

the other day, and he has sent me a copy of a draft Article in the proposed new consolidating China Order in Council. I

enclose a copy of this draft.

2. The new draft ole-re up one doubt which arose in

Bushby's case, but the difficulty still remains that then a deportee has to be transhipped here the Governor has no power to compel the master of any ship to receive the deporteę The Judge of H.B.M. Supreme Court at Shanghai has power to

require the master of any British ship to take a deportee. The penalty for refusal is 250. This in under Articles 123 and 124 of the China Order in Council, 1904 (pages 315 and

316 of the Directory for 1921).

姿。 Mr. Skinner Turner tells me that they frequently have trouble at Shanghai over this point. I think that the objection of the shipping companies rests chiefly on the fact that the British authorities in China provide no escort for their deportees. The shipping companies paint out that they have no means of guarding such prisoners, especially

in the case of Chinese crews.

4. The question arises as to whether we should legislate on the subject here. There are two questions, one of policy, and the other of competence. On the question of competence, while the actual process of placing the deportes on board would take place within our jurisdiction, the effect of that action would continue outside our jurisdiction, I do not like this type of legislation, but I am inclined to
